Our services and products include:

-
Group fitness classes and class plans.
-
Free and paid online training.
-
Online coaching subscriptions.
-
Structured training programs and fitness challenges.
-
Digital products, including downloadable e-books and PDFs.
By booking, purchasing or accessing a service or product, you agree to the terms applicable to that service or product.
Where you are required to acknowledge these terms before purchasing, you must confirm that you have read and understood them before proceeding.
Any separate written personal training agreement governs the specific arrangements it covers. These Terms of Service apply to other matters where they are consistent with that agreement and applicable law.
2. Service Information and Eligibility
Gravity Fitness provides fitness and exercise services intended to support strength, fitness, confidence and general wellbeing.
Each service or product may have different features, inclusions, access periods and participation requirements. Customers should review the relevant product description and purchase conditions before proceeding.
Our in-person gym and training services are intended for adults. Additional eligibility or participation requirements may apply to particular programs or challenges.
We aim to ensure that service descriptions, prices and advertised inclusions are accurate and up to date. Where an error or material change affects a customer, we will address it in accordance with the applicable agreement and consumer law.
3. Customer Responsibilities and Exercise Safety
Customers are responsible for providing accurate and relevant information when registering, booking or participating in our services.
You agree to:
-
Disclose relevant injuries, medical conditions and exercise limitations.
-
Complete any required health screening or onboarding forms.
-
Follow reasonable safety instructions and exercise guidance.
-
Use equipment responsibly and respect the studio, equipment, coaches and other participants.
-
Inform us of any relevant changes to your health or ability to exercise.
We may request medical advice or clearance where reasonably appropriate. We may restrict or postpone participation where reasonably necessary for safety, subject to applicable law.
Exercise involves inherent risks, including muscle soreness, strains, falls and other injuries. You should exercise within your abilities and seek advice from an appropriately qualified healthcare professional where needed.
Our fitness services are not a substitute for medical diagnosis or treatment.
Our separate Exercise Disclaimer provides further information about exercise risks and participation. Nothing in these terms removes rights or guarantees that cannot legally be excluded.
4. Group Fitness Classes and Class Plans
Gravity Fitness offers group fitness classes through various class plans, which may include class packs and recurring plans.
Depending on the options currently available, class plans may include:
-
Three-class or six-class packs.
-
Weekly class plans.
-
Monthly class plans.
-
Three-month class plans.
The price, number of sessions, validity period and other applicable conditions will be disclosed for each plan at the time of purchase.
Class plans are customer-managed and have no contractual lock-in beyond the plan or billing period purchased, subject to any disclosed plan conditions and applicable law.
Customers are responsible for managing their class plans and bookings through the Gravity Fitness website or the Fit by Wix app connected to our booking system.
4.1 Class cancellation and rescheduling — 12-hour notice
Customers may cancel a class booking and, where their plan permits, reschedule their booking themselves through the website or Fit by Wix app, provided they do so at least 12 hours before the scheduled class.
If a customer cancels or attempts to change a booking inside the 12-hour window, the booking system may not allow them to remove themselves or reschedule the session. Where the 12-hour deadline has passed, the session will ordinarily be forfeited and will not be reinstated merely because the customer cannot attend.
4.2 If you cannot attend within the 12-hour window
Our classes may operate a wait-list so another customer can take an available place.
If you cannot attend but are unable to remove yourself through the booking system because the 12-hour deadline has passed, you must notify Gravity Fitness as soon as possible. We can then manually remove you from the class and give someone on the wait-list the opportunity to attend.
Failure to notify us when you cannot attend may prevent another customer from taking your place. Repeated failure to notify us may result in restrictions on, or permanent removal from, our services, depending on the circumstances.
We will consider the circumstances of the situation and any applicable legal obligations before taking action.
4.3 Managing class plans
Customers are responsible for monitoring their own class plans, bookings, billing arrangements and renewal dates.
Gravity Fitness does not routinely cancel customer-managed class plans on behalf of customers. Customers must use the available website or Fit by Wix controls to manage or cancel their plans.
If you are unable to access the relevant controls, contact us promptly so that we can assist with the issue.
5. Class Plan Payments and Failed Payments
Class plans may involve a one-off payment or recurring payments, depending on the plan purchased.
Where a class plan payment fails, the payment system will attempt to collect the payment up to three times. If payment continues to fail after these attempts, the class plan will automatically cancel.
We do not currently impose separate late-payment fees or failed-payment charges.
If your plan is cancelled following repeated failed payments, you may need to purchase or activate a new plan to continue attending classes.
Any payment processing, cancellation or access arrangements will remain subject to the terms disclosed for the relevant plan and applicable law.
6. Class Plan Cancellations and Refunds
Customers are responsible for cancelling their own class plans before a future renewal or payment becomes due, using the available website or Fit by Wix controls.
Forgetting to cancel a plan, going on holiday, being unavailable to attend classes or choosing not to use a purchased plan does not ordinarily entitle a customer to a discretionary refund.
Class packs and plans have the stated session allowances, billing periods and validity conditions communicated at purchase. Unused sessions do not automatically create an entitlement to a refund or extension.
However, these conditions do not remove rights available under Australian Consumer Law or other applicable law. If Gravity Fitness fails to provide a service as agreed, or another circumstance gives you a legal entitlement to a remedy, we will assess the matter accordingly.
If you believe you are entitled to a refund or other remedy, contact us with the relevant booking or payment details.
7. Online Coaching and HubFit Subscriptions
Gravity Fitness may offer free and paid online training or coaching through HubFit.
The features and inclusions of each plan are described on the relevant product page. Depending on the plan, these may include training programs, exercise demonstrations, workout tracking, progress records and other digital resources.
Unless expressly included in the product description or agreement, access does not automatically include individualised programming, personal coaching, progress reviews or ongoing direct support.
7.1 Managing paid subscriptions
Customers with paid HubFit subscriptions can manage their subscription through their account profile. The subscription management process may direct customers to Stripe, where they can update payment details or cancel their subscription.
Subscription customers are responsible for managing their own payment details and cancellations using the available account controls. The relevant subscription page or checkout information will explain any applicable billing and access conditions.
A cancellation generally stops future recurring payments according to the applicable subscription arrangements. It does not automatically entitle a customer to a refund of previous payments, subject to applicable law.
A Start Here program may be provided to help customers understand how to use the HubFit app and manage their subscription.
7.2 Failed payments on paid services
Where a payment for a paid online service fails, the payment system may attempt to collect the payment up to three times.
If payment continues to fail after these attempts, Gravity Fitness may terminate access to the paid service and cancel future payments or the associated subscription.
We do not currently charge separate late-payment fees or failed-payment charges.
Any termination will be handled consistently with the applicable subscription arrangement and legal obligations.
7.3 Free HubFit access
Our free online training plan is not a paid subscription.
Customers may request cancellation of their free HubFit access by emailing harleycurry.lpc@gmail.com.
To manage limited platform capacity, Gravity Fitness may deactivate free accounts that have not been used for 30 consecutive days. Where an account is deactivated for inactivity, the customer may sign up again if they wish to resume using the free service, subject to the service's availability and requirements.
If deactivation would affect any information the customer wishes to retain, they should contact us before the account is deactivated.
8. One-Off Structured Training Programs and Challenges
Gravity Fitness may offer one-off digital training products, including structured training programs and time-limited challenges.
Examples may include six-week, eight-week and sixteen-week training programs and seasonal fitness challenges. Available products and their inclusions may change over time.
8.1 Access period
A one-off purchase of a structured training program or challenge provides access for the period of the purchased program, as described on the relevant product page.
Payment does not provide lifetime access to these training programs. Access ends when the applicable program access period expires, unless a different arrangement has been expressly stated.
Customers should review the program duration, start arrangements, training schedule and inclusions before purchasing.
8.2 Fixed schedules
Some programs and challenges follow a fixed calendar or scheduled training period. Purchasing a place in such a program does not automatically entitle a customer to reschedule the program dates or extend access because of personal scheduling conflicts.
These conditions do not remove any legal rights a customer may have if Gravity Fitness cannot provide the service as agreed.
8.3 Product inclusions and support
Each product page will describe the principal inclusions, equipment requirements and any stated support arrangements.
Unless expressly included, purchasing a program does not automatically include personalised coaching, individual program modifications or ongoing direct messaging with a coach.
9. E-Books and Downloadable Digital Products
Gravity Fitness may sell e-books, PDFs and other downloadable digital products.
Where a product is supplied as a downloadable PDF, customers may retain and use their downloaded copy for personal use after downloading it.
We may remove an e-book or other digital product from our website at a later date. If you have already downloaded the file, you are responsible for retaining your own copy.
Unless otherwise stated, downloadable products are licensed for personal use only. Purchasing a digital file does not transfer ownership of the intellectual property in that file.
Nothing in this section excludes any consumer rights or remedies that may apply to the purchase.
10. Prices, Payments and Billing
Prices, payment frequency, payment methods and applicable conditions will be disclosed on the relevant product page, booking page, checkout or separate agreement.
Payments may be processed through Stripe or another payment method made available by Gravity Fitness.
For recurring plans, customers should check the stated price, billing frequency and cancellation process before purchase.
Customers are responsible for ensuring that their payment details are accurate and that sufficient funds are available for authorised payments.
We do not currently charge separate late-payment fees or failed-payment charges. This does not prevent a payment from being retried or a paid service from being cancelled in accordance with the applicable payment arrangement.
We will communicate changes to prices or recurring payment arrangements in accordance with the applicable agreement and law. A price change will not automatically override an existing contractual commitment.
11. Refunds and Consumer Guarantees
Gravity Fitness handles refund and remedy requests in accordance with applicable Australian Consumer Law and other relevant legal requirements.
Customers are not automatically entitled to a discretionary refund because they change their mind, forget to cancel a plan, go on holiday, fail to attend a booking or choose not to use a purchased product.
However, consumer guarantees may apply to services and digital products. Depending on the circumstances, customers may be entitled to a refund, replacement, resupply, cancellation or another remedy where a product or service fails to meet an applicable consumer guarantee.
Nothing in these terms is intended to exclude, restrict or modify any right or remedy that cannot legally be excluded.
12. Intellectual Property and Permitted Use
Unless otherwise stated, content supplied by Gravity Fitness is owned by or licensed to Gravity Fitness. This includes training programs, exercise plans, written guides, recipes, videos, graphics, images and other original materials.
Customers are granted permission to use purchased or freely supplied materials for their own personal training and fitness purposes, subject to the relevant product terms.
Unless we provide written permission or the law otherwise allows it, customers must not:
-
Copy, reproduce or redistribute our materials for commercial use.
-
Resell, sublicense or share paid program content with others.
-
Publish or distribute our materials as their own work.
-
Use unauthorised copies of our materials to create or sell competing products.
Purchasing access to a program or digital product does not transfer ownership of its intellectual property.
13. Website and Third-Party Platforms
Gravity Fitness uses third-party platforms to support website operation, bookings, payments, online coaching and digital product delivery. These may include Wix, Fit by Wix, HubFit, Schedulista and Stripe.
Use of a third-party platform may also be subject to the provider's own terms, conditions and policies.
We do not control every aspect of third-party platform availability or operation. If a technical issue affects a service you have purchased, contact us so that we can assess the issue and determine an appropriate response.
Our handling of personal information is explained in our separate Privacy Policy.
14. Suspension and Termination of Access
Gravity Fitness may suspend or restrict access to a service where reasonably necessary for safety, security, unlawful conduct, misuse of our materials or a material breach of applicable terms.
Repeated failure to follow reasonable class attendance and notification requirements may also result in restrictions on, or removal from, our services, depending on the circumstances.
Where appropriate, we will communicate the reason for the action and any available steps to resolve the issue.
We may also discontinue or change products and services over time. Where a change materially affects a service already purchased, we will address it in accordance with the applicable agreement and consumer law.
Nothing in this section gives Gravity Fitness an unrestricted right to cancel a customer's purchase or avoid its legal responsibilities.
15. Complaints and Dispute Resolution
If you have a concern about a booking, payment, subscription, digital product or other Gravity Fitness service, please contact us and explain the issue.
We will review the matter and aim to respond within a reasonable period.
If a concern cannot be resolved directly, you may have options under applicable consumer protection laws or through the relevant consumer protection authority.
Nothing in these terms prevents you from exercising any legal rights available to you.
16. Applicable Law
These Terms of Service are governed by the laws applicable in Queensland, Australia, together with relevant Commonwealth laws, including Australian Consumer Law.
Any dispute will be dealt with in accordance with applicable law and the jurisdiction of the relevant courts or tribunals.
17. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes to our services, systems, business practices or legal requirements.
The latest version will be published on our website with its updated date.
Changes to these general terms will not automatically override a separate agreement or remove rights already available to customers under applicable law. Where required, we will notify affected customers or obtain agreement to relevant changes.
